Please shift the victim immediately to the nearest hospital or government hospital and inform your management about the full details. Also, inform the Police Station in your jurisdiction.
Inform the Labour Commissioner Officer (Contract Labour License Issuing Authority) through a formal letter and request details about the compensation to be paid to the victim or the victim's family, as per the BOCW Rules.
Submit the compensation amount via Bank Draft to the Workmen Compensation Commissioner or Labour Court, depending on the requirements in your state.
In the Unfortunate Event of the Victim's Death
- Gather documents such as Age Proof, Family Details Proof, and Dependent Certificate for the family members.
- Obtain copies of FIR, Panch Nama, Inquest report, Post Mortem Report, and Final Investigation Report from the nearest Police Station.
- Collect Hospital Treatment Details or Brought Dead Certificate along with the Doctor's death declaration from the Hospital.
- If cremation is done locally, obtain a cremation certificate from the crematorium.
- Apply for a Death certificate from the Municipal authorities along with the necessary declarations and certificates.
To claim PF Dues, Pension amount, or EDLI, advise the family members to open a separate Savings Account and provide copies of the passbook's first page and their identity proof.
Complete the PF related forms (Form 10D and Form 20) and submit them with Form 5 and Form 10 details to the relevant authorities.
Proceed with the Insurance Claim
- Death Certificate Xerox Copy duly notarized.
- Medical Expenses bill-wise details, original reports, and bills.
- Receipt of Compensation Paid to the family from WC Commissioner or Labour Court.
- Date of Birth Certificate of the Victim.
- Family Details or Dependent Details of the Deceased.
- Panch Nama or Inquest Report (including an English translation if in a vernacular language).
- FIR (including an English translation if in a vernacular language).
- PM Report (including an English translation if in a vernacular language).
- Translation of Death Certificate in English duly notarized.
Lastly, on humanitarian grounds, please provide full support to the family of the deceased worker.
