Hello Sir/Madam, I am a recent MBA graduate (2009-2011). I joined a BPO company two and a half months ago in June 2011. The terms and conditions leaflet provided to me at the time of joining, along with the offer letter, state that a notice period of two months must be served.
Recently, my doctor advised me to take a month's rest due to severe health issues. I have informed my line manager, team lead, and HR about my condition, and they seem to understand why I am unable to come to the office. I submitted my resignation on 2nd September 2011 and have been following my doctor's advice by resting at home since then.
I received a call from HR informing me that they have discussed with my manager, and they are willing to release me, but I would need to buy out the notice period. My resignation is still active.
Questions Regarding Notice Period Buyout
I have two questions:
1. How does the buyout of the notice period work - is it based on the basic salary for two months or the net salary credited to my account?
2. As a fresher facing health issues, I believe the two months of experience gained would not be significant. I do not wish to show this experience and intend to start my career anew once I recover. In this scenario, what consequences would I face if I choose not to buy out the notice period? What are the advantages of buying out the notice period?

Normally, the buyout of N.Period is on basic salary. Check with your appt. letter conditions. Pon

Like Pon mentioned, the buyout of the notice period is usually with respect to the basic salary, but since your Appointment Letter mentions "Annual Gross Compensation," it will be based on the Gross CTC in your case.
Regarding your second query, please note that even though you intend to restart your career, ensuring a clean record by leaving this employment with clarity is essential. By doing so, you are only ensuring that your career record remains clean. If you do not depart from this company with the records in order, this company may place you on their "Absconding" list. With more and more companies exercising background checks during the hiring process, this could pose a risk from a long-term perspective.
Currently, background checks are conducted concerning the companies where one has worked, as indicated in the resume. However, with the Skills Register/Repository being discussed regularly now, it is possible that situations where employees conceal their employment track history may come to light.
Please consider this carefully and make your decision accordingly, as ultimately, it is your career.

Thank you for your advice. I just want to know if the "ABSCONDING LIST" really exists. I am not registered in NASCOM (Skill Repository). Do companies register us in NASCOM as soon as we get employed with them? I have heard that the absconding list prevents you from returning to your previous employer as it is internal to them. Will it be made available externally?
The team lead told me that I would be listed in the "absconding list" and I will not be placed elsewhere. As I mentioned before, I do not want this experience to affect my career start afresh. Can you explain the mechanism and functionality of the absconding list?
