Dear All Can you pls. help me to know something about Shops & Establishment Act? Also, how it is registered and whom to be approached for the same? Rgds Sundu.

You shall have to approach the office of the Commissioner Labour department of your city for the registration. Don’t worry if you have to grease some palms for getting this registration.

Dear Sundu,

You just need to go through the Shops and Establishments Act, 1947. This is the only act regarding shops and establishments.

If you want to register, consult the nearest Labour Office and discuss with the Labour Officer, Assistant Commissioner of Labour, or Deputy Commissioner of Labour.

Hi,

Since you are located in Bangalore, you might as well go to the labor office which is located after Dairy Circle (Karmika Bhavan if I am not wrong). Visit after 14:00 hrs in the afternoon since none of the labor inspectors are available before this time as they go out for inspection to their respective circle.

Secondly, find out under which circle your office comes (location in Bangalore). Go there, and you will get the form which is self-explanatory. Specify the number of employees in your organization, and as per that, you will have to pay the registration fee. Once you get the certificate from Karnataka Shop & Establishment, the same is valid for a period of 5 years, and you will have to frame the same and keep it on the premises to avoid trouble with the authorities when they come for inspection (as they have the power to do that). Dear Sundu,

As others have said, you have to approach the office of the Labour Commissioner, Dy. Labour Commissioner, or Labour Officer, depending on the area in which your shop or establishment is located. According to the Shop and Commercial Establishment Act, for registration under the same, you have to provide information related to the employer (name, age, address, status, etc.), and employees (name, father's name, date of joining, shift working hours, days of rest, etc.) on forms A, B, and F. You are also required to pay some registration fees as per the state government's Labour Department notification.

When you are registered with the shop and commercial establishment, you are bound to comply with all the statutory provisions applicable to shops or commercial establishments. Purchase the forms, complete them, and submit them to the concerned authority. A shop inspector may visit for verification of the site and information provided by you.

Hi,

By PT, do you mean Profession Tax? If yes, then you will have to go to Platform Road (parallel to Seshadripuram Road). The office is located in Slum Clearance Board Building (you might find the name funny, but this is where it is located). Give the details of your company on the prescribed form and pay the fees. Once this is done, keep the acknowledged copy.

After this, you will have to submit Form 5A in duplicate and submit along with the cheque to the nearest State Bank of India (try St. Marks Road branch if your office is on MG Road). The second acknowledged copy you will have to keep in your file for reference. You must be aware that the PT is deducted as per the salary slabs ranging from Rs. 200, 150, 100, 60, and 30.

Please cross-check again with somebody because I have written whatever I know and presently I am based in Kuwait and not India. Hope your query has been answered.

Professional Tax registration in most states is under the purview of the commercial taxes department of the state. Try to find out the said department & approach them as required.
