Hi all, Can anyone pls tell me how many types of leaves are there in an organization? What is privilege leave? Who all are entitled to get this kind of leave? Expecting response....... Regards, Pooja

Hi Pooja,

Mostly, there are 3 types of leaves prevailing in organizations:

1. Privilege leaves / Paid leaves / Earned leaves - 16
2. Casual leaves - 8
3. Sick leaves - 8

Out of these leaves, casual and sick leaves can be availed only during that financial year, whereas Privilege leaves are carried forward to the next financial year and can be encashed. In some companies, it gets encashed on a yearly basis, while in some companies, it gets encashed only at the time of separation from the company.

Besides the three types of leaves viz. sick leave, casual leave, and privilege leave, some companies have the provision of Compensatory Leave. Maternity Leave is also applicable as per the law. Some companies also provide Paternity Leave.

Hi,

Generally, leaves are of several types, such as:
1. Casual leaves
2. Medical leaves
3. Earned leaves
4. Maternity leave (12 weeks)
5. Long-term leaves (for educational purposes)

These types of leaves are generally followed by organizations. However, the allocation of leaves (how many days) depends on the nature of the organization.

Dear Friend,

The different types of leaves are:

Earned Leaves/Privilege Leaves: These are the leaves that are earned in the previous year and enjoyed in the preceding years. They are also known as privilege leave and can be carried forward for a quantum up to the total of three years, varying from state to state as per the Shop & Establishment Act. These are encashable on basic salary to the employee. The conditions for taking these leaves usually differ from company to company but normally require a request in advance of at least 15 days. These leaves can be clubbed with sick leave if the sick leave balance is insufficient.

Casual Leave: These leaves are granted for certain unforeseen situations or when you are required to take one or two days off. In the case of casual leave, companies usually have a strict maximum of 3 days per month. In these cases, either the person needs to seek permission in advance or the leave has to be regulated upon joining. Casual leave is usually not clubbed with privilege leave, but it can be combined with sick leave if there is no sick leave balance. The quantum varies from state to state as per the Shop & Establishment Act, and normally, this leave is not encashable or carried forward. To attract people and reduce absenteeism, any remaining casual leave balance at the end of the year is converted to privilege leave in the leave account.

Sick Leave: These leaves, as the name implies, are for when an employee is sick. The quantum is determined by the Shop & Establishment Act in different states. Sick leave can be carried forward if there is a balance, with the logic that a person may face severe illness requiring medication and leave during that period, usually recommended to carry forward for up to 45 days to prevent lapse. This accumulation also helps reduce absenteeism due to minor illnesses. If a person is sick for more than 3 days, usually a medical certificate is required.

Maternity Leave: It is granted for 12 weeks, six weeks before and six weeks after delivery. The lady must submit a fitness certificate before returning to duty. Further information on this leave has been provided by Ms. Shilpa.

Leave Without Pay: If a person does not have any leave balance and the situation necessitates a leave, the company may grant leave without pay, which can be adjusted against future leave or, in special cases, as special paid leave based on the person's contribution to the company at management discretion.

Compensatory Off: These leaves are granted if a person works during holidays, usually compensated as leave to be taken or as an encashable option.

Dear friend,

Apart from those leave types already mentioned, there are also the following types of leave:

1. EOL (Extra Ordinary Leave)

This is usually granted when all other leave to the credit of the employee has been exhausted. This is also known as leave on loss of pay. No salary is eligible for those days on which the employee was on leave.

2. ACL (Additional Casual Leave)

This is granted in addition to casual leave. The number of days of ACL eligible is determined based on the holidays declared during the calendar year - including those declared by the Negotiable Instruments Act. In PSUs, it is 23.5 days minus total holidays declared during the calendar year (excluding those falling on Sundays).

3. SPECIAL SICK LEAVE

This is granted when all sick leave has been exhausted, and the employee suffers from some major health ailment. This is restricted to say 90 days during the entire service. This is paid leave.

4. DIES NON

This is unauthorized absence and it amounts to a break in service. This may attract disciplinary action.

Dear Friend,

There is one other leave type called Quarantine leave. This is granted to the employee when a member of the employee's family is suffering from an infectious disease like chickenpox, typhus fever, brain fever, etc. The local administration body should declare such illness to be quarantined. If the employee himself is suffering from those illnesses, then he has to avail of sick leave.

I would like to ask, is there any law that states the minimum maternity leave must be 12 weeks, or can different companies have varying policies regarding the number of maternity leaves offered?
