Hi Friends,

I am working in a call center as HR. We face lots of attraction problems. We are planning to go for contract employees. Can anyone suggest to me and provide details on how to deal with contract employees, along with the rules and regulations for the same? I would be very thankful if you could do me this favor.

Conditions of Employment for Contract Employees

Hours of Work

The hours of work for contract employees shall be in accordance with the terms and conditions outlined in the offer of employment made to the employee and signed by him/her upon employment.

Pay Period

Contract employees shall be paid every second Thursday (depends) and will be placed on direct deposit.

Leaves and Holidays

1. The Company recognizes the following statutory holidays for contract employees who have worked for the Company for at least three (3) months and have worked their regularly scheduled working day immediately preceding and following the holiday (employees will be paid their regular daily wages):

2. Contract employees shall be entitled to vacation pay in accordance with the Employment Standards Act and the guidelines for support staff pertaining to vacation rollover.

Sick Leave

Contract employees are not entitled to be paid for sick leave days.

Employees who are injured in the performance of their duties shall be covered under the terms and conditions of the Workers' Compensation Act.

Benefits

Employees hired for a fifteen month contract or more and working a minimum of 24 hours per week shall be entitled to either of the following benefits:

Life Insurance/Vision Plan /Dental Plan & Drug Plan

Terms and Conditions

• single coverage only.

• eligibility after three (3) months continuous service - an employee whose contract is terminated and then renewed does not have to serve another three (3) month waiting period.

• enrollment offered upon date of eligibility.

• Participation in the plan is effective for the entire duration of the contract.

The Company pays pro-rata of benefit premiums based on hours worked; employee pays difference. The Company and the employee cost share the monthly premiums.

Contract employees working less than 24 hours per week or hired for less than 15 months shall be entitled to 4% in lieu of benefits.

Expenses

Mileage rates paid to contract employees using their cars on Company business, with the approval of the Company, shall be paid the mileage allowance established by the Company.

When an employee is required by the Company to travel out of the city on Company business, the Company will reimburse the employee for reasonable expenses in accordance with the policy and procedures of the Company.

Terminations and Resignations

Contract employees, where possible, shall give at least two weeks notice of his/her intention to resign. The Company shall have the right to terminate any contract by giving the employee a two week notice or the notice period specified in the contract.

Read the Contract Labour (Regulation and Abolition) Act 1970. Ask the vendor to get a contractor license. Your company should not have any employees working on a similar job profile. Obtain the required registration from the Labour Commissioner's office. Ensure that people maintain statutory registers, pay minimum wages, record exact time in and out, manage leaves/benefits, at least on paper. Ask the contractor to submit photocopies of muster roll, wage sheet, PF, and ESI challans along with the bill every month.

Repeat the same process for housekeeping, security contractors, etc.

Strategic tip: Do not outsource core areas; your company could lose out in the long run.
