Dear Sir,

Has the Amendment Bill 2010, Payment of Gratuity Act 1972 extending the limit of gratuity from 3.5 Lakhs to 10 Lakhs, been passed by Lok Sabha as well as by Rajya Sabha and notified in the Gazette of India? If so, please let me know the date of notification and the date of application.

The Payment of Gratuity (Amendment) Act 1972 was passed in Lok Sabha on 22.04.2010, thereby raising the limit from ₹3.50 lakhs to ₹10.00 lakhs, which will come into force from 22.04.2010. For details, please search "Payment of Gratuity (Amendment) Act" on Google, and you will find it. Hope this clarifies.

The actual effective date of implementation will be mentioned by the Labour Ministry at the time of notification, which will be signed by the Honourable President of India. Hence, please wait and do not spread false information.

Gratuity Amendment Bill 2010 Update

The Gratuity Amendment Bill 2010 was introduced on 22 April 2010 and passed by both Houses of Parliament. Now, it is to receive assent from the President. After that, the Labour Ministry will notify the effective date. Hopefully, they have given it retrospective effect so far.

There is a demand that it should be effective from 01 January 2006, as it was from this date that it was given effect to government servants. For other PSUs, it was effective from 01 January 2007. For other sectors, we pray to God for a retrospective effect.

The Ministry of Law and Justice has issued a notification in the official gazette on 18-05-2010. The date of effect of the revised ceiling may be decided by the central government through the official gazette. For authentic news, refer to the AIBOC (Andhra Pradesh Bank Employees Union) circular no. 71 dated 20-05-2010.

Gratuity Amendment and Its Implications

The date of effect for the gratuity amount must be from 1/1/2006, aligning with central government employees. Since an amendment has been enacted by Parliament, which should ensure equity of law, there should be no disparity or discrimination. This is a serious matter and requires mass representations to the Labour Ministry. Please raise the issue vigorously.

To correct the date to 24th May 2010 for the remaining sectors (other than government employees and Public Sector Undertakings) is truly discriminatory. Even RBI employees have received it retroactively. The reason why this action is not made applicable from 01.01.2006 to all sectors is unclear.

I retired from Coal India Ltd. Coal India raised the gratuity limit from 3.5 lac to 10 lac w.e.f. 1st Jan 2007. However, the payment is being done by deducting 10% income tax. Please clarify for me what is the notification, and from which date will it be effective in Coal India Ltd., a public sector unit.
