i shared my citehr experience with one of my friend. he has given us a situation to get a solution:
His factory engaged a canteen contractor to cook food in a kitchen outside the factory and bring food inside during lunch/breakfast time and serve to employees. The contractor engaged 17 contract labours for this activity. Labours used to be inside factory during lunch / breakfast time only.
Is it required that those contract labours should be covered under PF and ESI ?? Out of 17 only 9 used to come inside factory. Rest used to manage kitchen/shopping etc outside only.
The company pays contractor per unit of meal /breakfast basis and a lumpsum amt for his admin cost ( kitchen rent/manning cost/untensil rental, fuel etc).

The debate here is that the Company take food on per plate cost and the persons are working partly inside, partly outside and not for 8 hrs. if so, then what about agencies/vendors who supply raw material, spare part, packaging material, ppe, stitched uniforms etc to the company...... in a way these all are linked to manufacturing process directly or indirectly.
Is the Company responsible for such labour /contract labour's (who are engaged in above activities) pf/esi compliance...... ??

No need to give the pf & esi facility, why the principle employer give this facility if e'er paying his bill / payment. if any like that law or requirement then pls share me also, i have also like that problem.
