Hi,

I was working with an ISO certified company and did work for approx. one year and everyone was happy with me but one day, I got to know that my wife is pregnant and I need to go back to my home town (to shift) so that I can stay with my family (parents) and my wife can be taken care well with them.

So I talked to the company management for 3 months leave but with little discussion, they agreed to release me in one month of time (from my job as they were not happy to give 3 months of leave) so I submitted my resignation letter and went for 2 weeks of personal leave after approval only. Once I joined back, I resumed my work with the company and when I was getting ready to come back to my home town. The company director asked me to work extra at home for them so that I can support them for some of extra projects (I had already finished my work but they needed my expertise for some other projects). I did this and supported them by working from home.

One day, I got a call then I have been terminated from my job due to disclosure of confidential information but there was nothing like that as I was working extra for them only and having access as provided by them only to work extra at my home. It was really shocking for me to know this but my wife was pregnant and I was about to join other company so I didn't give much attention to this issue and politely talked to the company directors and they listened to me for this so I was hoping that all settled now but they didn't give me any acceptance or work exp. letter.

Now, after 6 months, I got some policemen to ask me that the company has filed a legal case against me due to breach of confidentiality and now I am not understanding what to do now.

Earlier, I was planning to file a case against them for illegal termination of my job but as I had already resigned from there and got a better opportunity so I didn't give much notice to it to avoid my time waste but the way, I got the police at my home, it made me to think about this whole.

Please someone suggest me what to do now as they had not given me any relieving letter after my resignation and every communication was held on that company email ID only because we were not supposed to use any other email there.

I have a small family of mine and working nicely with a company and really don't want to get involve in such issue so please suggest me what to do now - if you need any information from me to assist better on this then please let me know and I will be able to provide whatever I could.

Option1: Approach your previous employer to resolve the issue and discuss all your positive points with them and request them to withdraw the case on good terms.
Option2: If you want to go legal, have a legal advisor and go ahead with legal proceedings against the company. If you are really found to be truth and honest then no worries, you will win the case.

Thank you very much for your quick response.
I'll try the option 1 immediately but as if they do not accept it then I have only option2 to solve the matter but what if I don't have all the documents to support me even if I am true.
As every communication was held on the company emails only and they stopped access without knowing me in advance and all the supportive emails and everything is located there only.

Also, please let me know as if I can file an against case in current situation for my illegal termination 6 months back or that has been obsolete now due to my ignorance to go calm. Please suggest!

No worries even if you dont have any documents as a proof, when you file a case the investigation authorities will certainly contact your employer to provide them with your email pst, upon your statement (That all the proof mails are in your email account provided by the company).
Yes, you can go ahead with the legal action even after 6 months of termination, as you are only reverting legally in the case filed by your previous employer.
Do discuss with the legal advisor! But, try to make out of court settlement, convince them about your honesty.
