Hi
I am an employee of reputed company in Bangalore and currently doing rotational shift for USA shift. Due to the outbreak, company has requested to WFH in Bangalore and many employees in my team are working from home, but while checking managers are saying whoever works from Home will not be given shift allowance as per HR policy, many employess are also working in night shift also. Is there any law in India which we can use to claim this. They are taking advantage of the situation to deny shift allowance. We are supporting Usa timezone in India and currently 4 shifts which run under this. We are forced to go to office to get shift allowance. Is this legal, and can someone suggest a solution for this? thanks in advance.

Hi Jithu,
Please read the HR policy once again.Check whether the Policy says Shift allowance is to be paid on the working done during shift timings and is silent on the location of work OR the policy exclusively says that shift allowance will be paid only for work done during shifts in office only.If the policy is silent on location of work you can provide evidence of working done from home during shift hours and claim shift allowance. Situations like coronavirus are unexpected and short lived.HR should consider the work efforts of employees done from home and pay as per routine practice.
