Dear All,
one of my friend had applied to Gurgaon PF department for settlement his dues pending to be settled for the last one year. The respective forms were signed by the bank manager. He could not got the signature of his employer due to some unavoidable reasons as his account with the employer is still to be cleared. The amount of PF dues is substantial and to the tune of Rs.800000. The Pf department has rejected two times his forms after telephoning to him that you have to get it signed from the employer only. He is staying far from Gurgaon and can not follow personally.
Kindly advise the course of action.

Dear Ramesh,

You take either or all the following steps:

First of all tell us you are employed now or not. If you are employed you cannot/should not apply for final settlement. Are you sure your employer remitted all your PF to your PF A/c (if your's is an exempted Employer your PF A/c. shall be maintained by your employer's PF Trust themselves). Subject to this my suggestions are:

1. Send a registered letter with ack.due attaching the Final settlement forms which can be downloaded from the web sites and forward a copy to your Regional PF Commissioner.

2. After 15 days send a reminder, copy to the RPFC asking them to inform you the action taken.

3. If you know your PF Account No. check the position "On line" thro' the PF web site.

4. After a month if there is no progress send a legal notice with direction to them to hasten the settlement or Transfer as the case may be within 15 days.

5. If nothing is happening File a complaint with Grievances cell of the RPFC

6. File a suit with appropriate Consumer Forum for settlement/Transfer of your PF.

On the right of your screen you will find earlier postings & links for similar problems, use them as your guidelines.

PF amount cannot be adjusted against any dues whatsoever under any circumstances.

Follow up very closely.
