Dear All,
I have a unique case regarding ESI. My company due to some reasons the ESI process was not normal. So the ESI contribution list available with us for the year 2009 in which out of 100 employees 46 employees are present till date and their ESI is being deducted. Rest employees have left the organization.
Now the ESI contributions (challans) have been submitted till May 2010 but it does not have any employee list and the number of employees shown on the Challan are 83.
After my joining in September we have all the records of the employees whose ESI is being deducted but what about the months June to Aug 2010 as we dont know what were the number of employees during this period.
Can anyone help me with this or suggest any way out of this. Thank you in advance.
Thanks & Regards
Mahipal

Thank you for the response.
But problem is this company didn't had any HR related process in this organization. Earlier they used to pay a fixed amount of Salary to the employees without maintaining any Wages register or employee register.
Is there a way by which I can get the records from the local ESI office? Any idea?

If ur case is so pathetic, u can approach the ESI branch office concerned and request for the details of the employees and their ESI Nos. for whom you have submitted the Declaration forms. By which ur details of employees problem may be sorted out..
Even ur HR is not proper at that time, i feel ur accounts department may be worked something and booked wages amounts in ur accounts package or books of accounts, from which ur wage component problem will be solved...
with the above details i hope u can solve ur problem....... all the best......

Dear Mr. Mahipal
except the existing emloyees, You may make a dummy record to tally the challan you have. because , you dont bother about the left employees. in the same time you had paid the esi contribution also. so , considering the current employees , you may make a dummy report . and submit to esi office.

It is better to have a legal consultant for this matter.Otherwise the company would face several notices from the ESI

Very true. You will not be able to explain all the fine details of your problem at hand nd piecemeal advice will only confuse you.
Best, look for a reliable person to examone your records and advise you accordingly.
Cheers!!!!
