Hie All/Mr. N. Devrajan,
Kindly let me know that Leave encashment is a necessary payment that should be made to all the employees?
If a certain co. doesnt give the leave encashment benefit, but a right to avail all the leaves in particular financial year, which if not availed, are subject to lapse. then is it legal and acceptable?

As per my knowledge the govt. had decide to void the all excluded trust. All of the trust that doesn't have EPS Scheme have to take the regestration from RPFC for EPS scheme. Exempted Trust will remain same there are no chages. for any further clarification you can mail me on

Hi,
Is this applicable to a company who is excempt from PF beacause all the employees are above 10,000 basic but the employer is having a PF trust so that it forms an employee welfare scheme and to give them tax shelter.
I was told here that we do not have to worry.

Dear radhika,
If any company's all employee getting more than 6500 salary (basic + da) but having more than 20 employee it is still mandatory to having PF establishment code (registered with EPFO).

I thinks so. Isn't it??

Hi,
(Basic+DA) which exceeds Rs. 6,500/- but in our case all are above 10,000/- and we have a private trust operated by a third party. We had made a PL encashment to employees last year but did not deduct PF on it. When I checked here I was told that it is only for those Companies for whom PF deduction is a mandate.

Hi Radhika,
First of all tell me that your trust is established under EPFO (Employees Provident Fund Organisation) or private provident fund??
Secondly, if your establishment is covered under EPFO then there must be deudction on leave encashment.
Third, I am again saying it is mandatory for establishment (company) to register with EPFO if having more than 20 employees.

Hi all,
there is no note worthy amendement in the PF act. but there is a proposal to withdraw the ceiling limit of Rs.6500/-. That is irrespective of basic drawn by the employees.

Hi Saji, You are wrong. PF limit for deduction is still 6500. Dont confuse!! You might be heard of ESIC limit of 7500, it is also now 10,000 Regards Prashant Patil
