Hi,

When the employee decides to submit their resignation for a variety of reasons such as pursuing higher studies, getting married, finding a better job, etc., can HR request supporting documents like a wedding card or a registration form for higher studies?

If an employee is willing to buy out their notice period (as per the provisions of the exit policy), can HR compel them to serve the entire notice period?

Is the separation date determined through mutual agreement between HR and the departing employee, or does the organization have sole discretion in making this decision?

I am seeking clarification as I am quite confused. Some of my questions remain unanswered by the policies as well!

Hi Monika,

Firstly, HR cannot demand wedding cards and higher education details.

Secondly, regarding the serving of the notice period, it will be at the discretion of the management whether to relieve the person earlier or not. An employee cannot pressure the management.

Lastly, 99% of the time during separation, most things are done based on mutual understanding. Even if the employee is leaving the company for future prospects, they must take utmost care to ensure that the regular work is not hampered by their absence. On the other hand, the company should also understand the employee's problems and cooperate.

Dear Monika,

All actions should be in accordance with the company policies and principles of natural justice.

1. No, the HR cannot ask for supporting documents like wedding cards or offer letters from other companies.

2. No, the company cannot force you to serve the notice period if it is mentioned in the Appointment Letter/Contract of employment that the employee needs to serve a notice period of X days or pay in lieu of it. This is because, as per the contract, it is optional.

3. The separation date is not based on mutual consent. It must be followed as per service conditions (Notice Period). However, companies, depending on requirements, may mutually agree on a decided date.
