As my knowledge anyone having salary above 10000/- is not applicable for ESI Deduction. My salary till March 09 was 9000/- . Company declared increament of Rs. 1500/- :( in July W.E.F April 09.Thus my salary w.e.f April 09 will be 10500/-. Now as my april, may, & June salary was paid @ 9000 ESI deduction was made. Later co. gave us the arrers.
I have a question that whether I am applicable to get refund of 3 months (April, May & June 09) ESI deduction made by the Co. If yes kidly let me know the Rule under which I am applicable to get the refund.

dear legally you can not get any refund and it should continue to be deducted till sep 2009. regards js malik

dear it is law and apr to sep and oct to mar is ESI cycle.you can not stop contribution inbetween and it is to be stopped at the end of cycle. regards js malik

Once any amount is paid towards Govt. A/c, it is not easy to get refund.
Similar case was happened to me around 9 years back.
Since it was not possible to get refund, I asked the then HR head for adjustment in the next month.
Accordingly, before depositing the amount with ESI Dept., the amount was adjusted and refunded to me.

as per ESI cycle you can not stop contribution in between and it is to be stopped at the end of cycle. so in my veiw you will not get any refund

If one's increment is effected in between the cycle and the new salary is exceeded the limit, then he has to contribute towards ESI upto end of the cycle. But one is not liable to pay if increment effects from begining of the cycle.
For example, in case, by a mistake of HR Dept/ Accounts Dept. ESI is deducted from an employee in the month of April. It does not mean that the employee has to contribute to ESI upto end of the cycle.
So, there is no wrong in refund while doing adjustment in the next month.
