Dear Sir,

Our manufacturing company is located in Maharashtra, specifically in Pune's MIDC area. We are covered under the Factories Act, and our current manpower strength is as follows:

1) Permanent Workers - 50
2) Staff + Managers - 45 (including IT, Accounting & Finance, Store, Excise, HR, Audit)
3) Temporary Workers - 70 (on the contractor's payroll)

In my opinion, the support staff (IT, Accounting & Finance, Store, Excise, HR, Audit) are not covered under the Factories Act; instead, "Shop Act Registration" is required for them.

Please guide me on this matter.

Dear Mr. Prashant,

If your departments are all situated in the same premises as the factory, then there is no need to register separately under the Shops Act. Please remember that each registration is geographic location-specific and not to be considered department-wise. Usually, we declare the total number of people employed in the factory premises under the Factories Act when obtaining the license. So, there arises no way that one could leave a particular section/department staff. Think it over.
