Hi,
I need some help. I joined a company back in 2004, and then 4 months later, I left due to some family problems. I informed my employer that I could not continue. He then mentioned that if I were to leave, I would have to send my passport for visa cancellation; otherwise, he would have to report me missing, which could result in a ban from Dubai for 2 years. Is that true? And what happens after the 2 years? Can I re-apply for another job without any problems or worries about a lifetime ban or anything else?
Thanks

Dude, don't send your passport in any case. I'm working as a pro and can check your details to see if your visa is still valid. One thing to note is that they cannot renew your visa if you are not in the UAE. Let me know if you have your labor card number. I'll check for you.

Dear Pro,
Welcome to our forum. We were also searching for a person like you who can clarify the doubts regarding Labor Laws in the UAE. Is there any fee to lift the automatic ban? If he has completed 2 years of service and an NOC from the current employer is not available, or if he has less than one year of service but no NOC is available.
I have seen on the Ministry of Labor (MOL) website that there is a fee called the one-year ban lifting fee available. Is this applicable to employees without an NOC?

Thank you, Jatinvk. No, I don't have a labour card number, and I didn't send my passport. Do you work in the immigration department in Dubai? I have a friend who is getting me the details about my previous visa, that is if I have a ban or not. Do you have a Dubai contact number I could call you on if you can help me?
By the way, I went to Dubai in 2004 and left in the last month of that year. My visa was valid until I think October 2007. I just wanted to know, based on my situation, what ban will be applied to me and when does that ban exactly take effect: as soon as the visa gets over in 2007, as soon as I leave the country, or as soon as the employer informs me as missing.
Thank you,
Peter

Hi Suresh,
I work as a professional for my company and know about labor and immigration affairs. The ban and threats from sponsors mostly depend upon your labor contract signed initially for processing your labor card. Most of the information available online on their websites is outdated and vague. If you cannot find a way out, feel free to reach out to me. I would be glad to help you out.
By the way, my name is Jatin.
Take care.

Hi, I too work in the UAE. I think you must have sent your passport to your employer (if you trust) so that the visa can be cancelled. Your employer was correct, and he made you aware that he might file absconding. In that case, you cannot come to Dubai in any case. I don't know how Jatin missed this. As a professional, if you are out of Dubai for more than 6 months, your visa will be invalid. I think it is too late now, and your employer must have filed absconding. Better contact your company and check the status; they will clarify this to my knowledge. Sometimes we do this - we will get the passport and cancel the visa when the passport holder is in India.

Dear Sam,
Nice to hear from you, but to ask you one question... How can you report an employee absconding if he's outside the country? This means you have authorized him to leave, and that person has not come back. My dear, absconding means "the employee is working with another sponsor under your visa, without your knowledge," which is illegal according to labor law.
Well, you are correct that the residence visa will be invalid if a person resides outside the U.A.E for more than six months. But in that case, the sponsor can only cancel their visa and not report absconding.

TC

Dear Jatin,
According to our company policy, we are required to file absences for workers who have been granted leave for one month but are not reporting to work. We will wait for 10-15 days before filing the absence, regardless of whether the person is in India or any other country, as we are under immigration control. Could you please provide your mobile number so that I can call you when you are free?

Hi Jatin! I am new to this forum. It's really good that we have a Public Relations Officer here to guide us. Well, my questions are:
1. Does an employer have the right to terminate its employee before the probation period? If yes, what should be the situation in that case?
2. What is the process of a ban in companies here? Is it possible to lift the ban in any case?

Hi,
First of all, welcome to this forum.
Your first question was about termination during the probation period. Termination during the probation period is not as formal as after confirmation. The reason provided can be unsatisfactory performance.
The ban point can only be defined after knowing the current visa status, whether it is valid or the cancellation receipt of the labor card and residence visa.

Dear Jatinvk / Pro,
Finally, I have found a group that would be able to help me with my UAE visa concerns.
I left the UAE in July 2008 for a vacation. After a month, I submitted my resignation letter to my employer. However, he didn't accept it and asked me to think about it, granting me a 6-month extension.
In January 2009, I informed him that I would not be returning and that my resignation still stands.
I have since joined a company in the Philippines. In February 2009, I had to visit Dubai for a business trip. My company applied for a visit visa, but it was denied because my residence visa was still active.
I need to proceed with my Dubai business trip this April. I am puzzled as to why my residence visa is still active despite being out of the UAE for 6 months. Could it be because my employer extended it? If so, when can I expect my residence visa to be automatically canceled?
I would greatly appreciate your insights on this matter. I have been feeling anxious in recent days as I am under pressure to go to Dubai for my business trip.
Thank you so much.

Dear Jatinvk,
I used to work for one of the esteemed construction firms in Dubai from June 2007. However, due to some personal reasons, I came back to India on emergency leave in November 2007 and returned to Dubai in January 2008. Later, in July 2008, I came for my annual vacation, but due to personal problems, I could not return to Dubai, and even my visa was not cancelled.
Can you please let me know when I can enter the UAE on an employment visa from another company?
Thank you.

Sir,
My current company is not giving me a NOC. It's been a year in this company. How can I remove the 6 months ban? I heard in the newspaper that currently, Dubai's labor department is not imposing any ban. Please help me, sir.
Thank you.

Hello Jatin,
I am currently working in Oman and serving my notice period to join a company in Dubai. However, my Omani employer is insisting that I do not cancel my visa now and do it after two months. I need to know whether the UAE immigration will allow me to enter Dubai with an employment visa in my passport. If I manage to enter Dubai, will I be able to obtain an Emirati residence or labor card? Please help.

Dear Jatin Ji,
My name is Sachin Shirsath. I came to the UAE in 2003 and joined a company named Al Isikander at Jebel Ali Free Zone, which was a jewelry manufacturing company.
While working there, I experienced severe back pain, which required me to return to India for treatment in January 2004 with the owner's permission. However, upon recovery, when I tried to return, I was informed that it was not possible, and I should search for another company instead.
In 2006, I applied for a visa, but it was rejected on the grounds of absconding. Despite being told that the ban was only for six months, it persisted even after that period. Subsequently, in February 2014, my visa application was rejected again, citing the same reason.
I seek your guidance on how to resolve this issue. Your help and advice would be greatly appreciated.
Thank you and regards,
Sachin

I am Deepu. I was working in Dubai before 3 years in security services. I worked for 1 year and 2 months. My father died, and I went to India. I couldn't rejoin due to family problems. I read from sites that there would be a 1-year ban or a lifetime ban. If it's a 1-year ban, then it's probably finished. But if it's a lifetime ban, what should I do? How can I know that? I have applied for another visa for an oil company in Abu Dhabi. My old passport is lost, and it's my new one now. So will the visa be generated, and on arrival after a retina scan, will I be identified as an absconder and deported or punished? It's my doubt. Without canceling the older visa, can I go to UAE on a new visa? Will I be deported?

Hi Jatin,
I had got a job in Sharjah, UAE where I have worked for 20 days on my visit visa. However, I had to exit from the UAE as my visa was about to expire. The company where I worked had said that they would provide me with a Residence Visa. After returning to India, I received a good offer from Saudi Arabia. I informed my Sharjah employer about this, and he mentioned that my visa is ready but is demanding 10,000 DHS from me; otherwise, he will put up a Passport and Immigration GCC Ban.
I want to know whether he can impose a GCC Ban on me when I haven't yet visited the UAE on the company visa. Can someone please help me with this issue?

Dear Sam Sir and Dear Jatin Sir,
Nice to hear from both of you. Mine is also the same case. I came to India with the consent of the company as I was not well, and the reason to come to India was also my bad health. However, I couldn't go back, so they reported me as absconding. It's been 10 years now since I came back in 2004. Still, until last year, the ban is there, and the employer is not ready to talk. My visa was of Jebel Ali Free Zone. How can I lift the ban if the employer is not ready to help?
