Dear Sir, Good day to you. I am Naresh from India. I went to the UAE on an employment visa. After six months of work, I came back to India due to an emergency and did not return. I informed my company to cancel my visa while I was out of the country as soon as possible. They asked me to send them a copy of my passport with the entry and exit stamps. Three months after my exit from the UAE, my company called me, stating they urgently need my original passport to cancel my visa so they can use it for a new employee. Sir, I do not want to send my passport to them as I am afraid they might not return it to me. Please guide me on whether it is necessary to send my original passport for the cancellation of my employment visa according to the current UAE labor law. Is there another way to cancel my visa without sending my original passport? Please help me and suggest the best and right way.

Visa Cancellation Process and Employer Requirements

Cancellation of an employment visa is done by the employee through the employer/sponsor within the stipulated time upon cancellation of the employment card and before leaving the country.

You returned on emergency work. Generally, Gulf countries do not permit leave during emergencies, but it seems your employer made an exception in your case. However, you did not go back, putting you in breach of your contract and the law.

Despite this, your company is asking you to submit your original passport, which is necessary for the endorsement of the visa cancellation. Your company is willing to settle your account. You should promptly submit your original passport. The company will request you to sign certain forms, such as the cancellation of the employment card, a no-dues certificate, and an application for the cancellation of the visa, etc.

I may be completely wrong. I advise you to contact an immigration expert or approach Embassies and Consulates for clarification.

One needs to be careful about submitting a passport in its original form. What will the person do if the company withholds the passport? After all, if the person has left without notice and after giving the excuse of an emergency, the company may feel cheated by the employee's actions. Consult suitable people on this aspect.
