Dear All,

I seek your valuable advice on the matter given below.

I was working in the Real Estate/Construction Industry for the last 3 years in a responsible position. Due to some unavoidable circumstances, I resigned from the service. As per the company's policy, all confirmed employees should provide one month's notice period before resigning, and I did the same. However, in my case, they released me before completing my notice period.

Now, the HR Department is deducting my notice pay from my salary.

Kindly advise whether I should pay my notice pay to them or if they should reimburse me the same.

Dear [Recipient],

If you have written in your resignation that it may be treated as notice period or you have mentioned to be relieved on a specific date, and they have relieved you earlier than planned, management should reimburse you.

Yes, as Mr. Malik mentioned, until and unless we know the content of the letter, it will be difficult to suggest. However, if you have given one month advance information or are ready to work for one month, you need not pay anything. If the management wants to relieve you earlier, instead of deducting an amount from your final settlement, they have to pay one month notice pay extra. All the things are based on the letter you have submitted and what is mentioned in your appointment letter.

Dear Sir,

I have already mentioned the same in my resignation, but they are not paying me the same, and it's already been more than 3 months. I am still waiting for my FF amount. Even I am not getting any positive response from them after writing emails and calling many times.

Dear Friend,

If you have the acknowledgment copy of your resignation letter and mentioned relieving date as you were informed, then nobody has the right to deduct any amount from your Full and Final settlement.

If management has relieved you before your notice period, then management is liable to pay you for the one month or remaining days' payment.

You should once again try to convey to management the importance of maintaining a good relationship. If management does not agree, then you should send a legal notice through a lawyer along with all your documents such as the offer letter, appointment letter, confirmation letter, resignation letter, etc., to management and request them to cover the lawyer's fees as well.

I think this is not a good practice. If you have submitted your resignation and have given the required notice period, the company should not be deducting anything over and above the legally permissible amount (such as TDS and PF, etc.) even if they relieve you early. Kindly check with your ex-manager and ask for an income statement. This will give you a clear picture of the amount deducted from your salary.
