Good Morning Everyone,

I was working with a real estate company in Pune for 10 months as a CRM manager. I was asked to either accept a salary deduction due to company crises or resign without a notice period. I was informed that I would be paid my salary up to the date of resignation, so I chose to resign as I could not manage with a salary reduction from 18k to 13k. I was instructed to submit my resignation on a plain A4 size paper, which I did, and handed it over to my manager. However, the previous company is now refusing to pay the remaining salary, citing false reasons such as lost assets. Please help me with this issue.

I am sorry to hear about your situation. Please provide me with more details regarding your employer's failure to pay you. Are they a corporate company or small-time developers? Do they have other projects in different locations? How many people were or are currently employed there? Is the business still operational or has it been shut down?

Could you also share your current status and job title? Are you a worker or a supervisor? Since you mentioned that you worked with them for 10 months, were you still on probation during this time?

Do you possess any employment documents such as appointment letters, relieving/experience certificates, pay slips, or bank statements? How many months of salary are pending, and is this a common issue affecting many employees or just a few individuals like yourself?

Please provide the necessary information so I can better understand your situation and offer appropriate assistance.

Thank you very much for your response, sir. It's a small third-party company with a total of 54 employees. We handle everything from marketing to possession independently. Currently, we have 3 to 4 projects ongoing, and my role there was as a CRM executive. I have an outstanding payment pending for the last 15 days. However, the issues I am facing are likely to affect other executives as well. I am looking to disentangle myself from this situation. I have not received any formal documentation or payslips from the employer so far. But, I recently obtained an official email confirming my employment and responsibilities. I hope this information proves useful in resolving the matter.

I appreciate your concern for your beleaguered colleagues. I presume you would have signed some documents, including your appointment order containing terms and conditions, even if it has not been issued to you. What about EPF accounts and contributions to this account? This cannot be ignored since your manpower is stated to be at 54, which involves PF compliance. If yes, it should help you.

Non-payment of salary is an offense on the part of the employer. In the circumstances, to begin with, send a registered notice to the responsible officer, your HR Manager, asking them to settle your arrears within 15 days. You may decide on taking further action if they do not settle within 15 days. Yours is not a suitable case to pursue legally due to the legal expenses involved. Perhaps, if you have organized a union and obtained due recognition for it, that would help safeguard service-related issues for your colleagues. Document every development in writing, maintaining records concerning service matters.

Let us stay positive and work towards achieving the desired outcome.

Dear Abhinav,

Greetings!!

Do you have the letter copy you had given to your manager, i.e., the acceptance letter of your resignation? Could you please summarize what you had written in that letter and also provide information about your FnF (Full and Final settlement) details?

Once you provide this information, I can guide you in the right direction to receive your remaining balance payment, salary, and FnF.

Thanks & Rgds
