Hello Seniors,

I am working in an IT Company which has a registered office in the US but functions, and software development is done in the Indian office. The company is basically an 'LLC' company. I want to know what Indian laws govern an LLC company registered in a foreign country. I feel there must be some law governing such companies as to function here they have to register themselves. Do such companies have to follow all laws of the land they function in? Also, I would like to know the laws governing the Indian IT Industry.

Dear,

This company is to be registered under the Shop and Establishment Act of the particular state where it is located. All laws applicable to any other company covered under the Shop Act will also apply to this company.

Dear,

Leaving aside the Factories Act of 1948, all other Central and state laws will also be applicable to the IT industry. However, it is important to consider the number of employees in the unit and the location of your unit. State laws vary from state to state. There are approximately two dozen labor laws applicable in India to the organized working class, but one must review the proviso of applicability in each law to determine the final applicability of different labor laws.

Dear Mallik,

After one year of experience in the service industry, I transitioned to the Manufacturing Industry (Paper Plant). The production at this facility has not yet commenced. Given that it is a sister concern to another electrical manufacturing company, I am interested in undergoing an induction that will assist me in implementing HR policies at this paper plant.
