As per the Payment of Wages Act, 1936 Section 15(3), it falls under the definition of delayed payment. You can approach the Labour Department, and as per the provisions of this section, the penalty is ten times.

Actually, we don't have any appointment letter; we only received an offer letter. We were paid salaries for the first three months, and then the problems started. Could we take any legal action without having an appointment letter? We have attendance records with us.

Offer letter wont work here, better you consult with a lawyer(friend) and find out if you can thorw ball with payslip (I hope that you people have revd) Regards, Takecare
