Hi Team, I got the UAN account created by my previous employer almost 2 years ago, i.e., around March 2014. I left the organization in Sep 2014. While creating the UAN account, my date of birth was entered wrongly by my finance team. I noticed this mistake later in October 2014. I informed my previous employer about the error, but despite follow-ups, no action has been taken from their side, and the issue remains unresolved.
With my new employer, a new PF account was opened, and they attempted to merge all PF accounts with the UAN account for all employees. However, they were unsuccessful as the personal information on the UAN portal, specifically the date of birth, did not match with the new PF account opened by my current employer.
Despite providing the necessary information such as filled forms, UAN passbook screenshots, and copies of my PAN card and Aadhar card as proof to my previous employer, no action has been taken on their end. This negligence has resulted in a loss of interest amounting to Rs. 42,000 for the financial year 2015-16.
I would like to understand my rights in suing the previous company for my financial loss and how I should proceed with this matter.

First, take up the matter with EPF authorities about the less interest being credited on the working sheet. Or is it a case due to a DOB problem that your PF contribution was not deposited? At any rate, suing for the loss of interest can be done only when all other efforts fail, including getting in touch with EPF authority. Whether you will only end up spending lawyer fees or get interest is yet another question.

If somebody's name on their Voter ID is "Jashankumar Pareshlal Bhut," and on another photo ID, it could be "Jashbhai Pareshbhai Bhut." In this case, both names are different for the PF office, resulting in a DOB mismatch error. Therefore, I recommend checking all your documents to ensure that your name is consistent across all of them.
It's also possible that the leaving date from your previous organization was incorrectly entered into the system, leading to the same DOB mismatch error. If this is the case, you can contact them by emailing the UAN helpdesk or by submitting an online UAN complaint.

What can an employee do if his or her employer is reluctant to rectify the date of birth (DOB) and the spelling of his or her name? This employee has been pursuing the matter for the last eight years without any result. Whenever the employee raises the issue with HR, the manager tends to send a reminder to the consultant to take necessary action and then washes his hands of the situation. The employee continues to work for the same company, which is why he has not been able to take any action on his behalf. However, now that the employee is about to leave the company in one month, he plans to transfer his Provident Fund (PF) to the new company but is worried about his PF. Can you kindly suggest what he should do?
