Understanding Public Holiday Benefits and Presence Requirements in a Private Company - CiteHR

Under what conditions is a public holiday granted in a private company? Should it be mandatory to be present in the front or back?

If a month has a holiday on Sunday and public holidays on Monday and Tuesday, which day is required to be present in such a situation?

If I come on Saturday and Sunday is a holiday, Monday and Tuesday are public holidays, I do not come on Wednesday, will I get the benefit of public holiday?

The provision of public holidays in a private company largely depends on the company's policies and the labor laws of the country.

1. Generally, it is not mandatory to be present on the day before or after a public holiday to be eligible for the holiday benefit. However, some companies may have policies that require employees to be present on these days to receive the benefit. It's best to check your company's specific policy on this.

2. In the scenario where a month has a holiday on Sunday, followed by public holidays on Monday and Tuesday, the requirement for presence would again depend on your company's policy. Some companies may require you to be present on the day before the first public holiday (in this case, Friday) or the day after the last public holiday (in this case, Wednesday) to be eligible for the holiday benefits.

3. If you work on Saturday, and Sunday is a regular off day, followed by public holidays on Monday and Tuesday, and you choose not to come on Wednesday, your eligibility for the holiday benefits for Monday and Tuesday would typically not be affected. However, your absence on Wednesday would be treated as per your company's leave policy.

Remember, these are general guidelines and the specifics can vary based on your location and company policy. Always refer to your company's employee handbook or consult with your HR department for accurate information.

  • Dear Member,

In our opinion public holidays are being declared by Govt. for the employees working with them while in your case you are working in private company in accordance with the applicable law of India you are entitled for the grant of National & Festival Holidays if your company is covered under the Shops & Establishment Act of the respective state then you are to go through Act for these holidays & if your company is covered under Factories Act, 1948 then also you are to see the state C&S Leaves & N&F holidays Act if applicable in that state where you are working. Now if none of the Act is applicable then you are to see the policy of the company for this matter.
