We are covered under ESIC and PF in Andhra Pradesh, and we manufacture garments. Now, we are opening a branch in Tamil Nadu that will employ not more than 6 to 8 individuals. Since there are fewer than 10 employees, do we need to include the employees of Tamil Nadu under ESIC and PF as well? Please guide.

As per the regulations, if you have less than 10 employees in the new branch in Tamil Nadu, you are not required to include them under ESIC and PF coverage. The current threshold for ESIC and PF applicability is 10 or more employees. Therefore, with 6 to 8 employees in the Tamil Nadu branch, they would not fall under the ESIC and PF coverage. However, it is advisable to regularly monitor the number of employees and ensure compliance with any changes in the labor laws or regulations to avoid any penalties or non-compliance issues in the future.
