One of our employees' service was completed 5.5 years ago. Subsequently, he was admitted to the hospital for ESI leave, and now he is unable to continue working due to his health condition. The question at hand is how many years should be calculated for gratuity: 5.5 years or 5.8 years? If it is 5.8 years, should we calculate it as 6 years or 5 years only? Your suggestions are appreciated.

For calculations, the years are rounded of! Even if it is 5.5 or 5.8, for calculations they will be rounded off to 6 years!

Accordingly, if the employee has served for 5.5 years, it should be calculated as 6 years as per the Act. For eligibility for gratuity payment, one should have put in 5 years of continuous service in the organization.
