Dear Sir,

Our company's registered office is in Daman, and we have several offices in India. Out of these, two branch offices (marketing & project) are located in Delhi. The company also has its own rules and regulations regarding leave, travel, etc.

Is there a requirement for registering the Delhi offices under the Delhi Shop and Establishment Act or the Factory Act? Which rules will apply for calculating leave and other benefits?

Please help me.

If there are two branch offices (marketing & project) in Delhi, it will definitely come within the purview of the Delhi Shop and Establishment Act and not the Factories Act. Enforcement in Delhi is very strict. It is high time you go through the registration process. Get a local consultant to guide you in the process and compliance angle.

Actually, all new registrations under the Delhi Shops & Establishments Act have been kept in abeyance. This means that currently you do not need to register your Delhi office, but you still need to fulfill all the provisions of the Act.
