Hi, please provide your suggestion regarding the applicability of ESI to construction workers working on-site. As far as I know, ESI is not applicable to construction workers working on-site. However, some ESI inspectors are claiming that ESI is applicable to certain site workers, such as those working in painting or as electricians.
Kindly send me a notification regarding the applicability of ESI to construction workers.

Dear HR Professional, you first need to check whether the GIDC area is covered by ESI or not. The ESI limit is a gross salary of Rs. 15,000, so it should be deducted from the mentioned amount.

As per my knowledge, GIDC (Antalia) area falls under Navsari district, and GIDC is located in non-implemented areas in Surat (Gujarat) as per the ESI scheme. However, ESI is not applicable to the GIDC area. The ESI salary limit is Rs. 15,000/- excluding the Washing Allowance.

For the present, the ESI Act is not applicable to construction workers engaged in the construction of new building projects, etc. However, a construction firm employing 20 or more persons (presently it is 10) in their office is coverable under the ESI Act, provided the firm is located in an implemented area. The coverage limit is Rs. 15,000 with effect from 1-5-2010.
