During the Covid lockdown period, quite a few employees were working from home. Will they be eligible for a bonus for the period when they were working from home, or is physical attendance in the office mandatory for claiming a bonus? Please guide.

The method of executing the work and disbursing the bonus payment are two unrelated things. The Payment of Bonus Act, 1965, does not stipulate that work must be done only at the company's premises. Modern workplaces differ from traditional ones. Some employees may work from home permanently, some only at the company premises, and some may have a hybrid working method. Regardless of the work method, the entitlement to the bonus remains the same as for salary and wage disbursements.

The employees who worked for 30 days between 1st April 2020 and 31st March 2021 are eligible for a bonus, regardless of whether they worked from home or at the office/workplace. The management must determine the amount of the bonus according to the rules, taking into account their length of service.
