A government teacher in a government school has threatened the exam team, stating he will harm them and "teach them a lesson." As the head of the school, I need to draft a show-cause notice to the employee. Could someone please assist me in drafting the SCN?

Legal Action for Threatening Behavior

Threatening to kill is a criminal offense. The examination team must file a First Information Report (FIR) with the police and submit a copy to the establishment. Based on the police complaint, the employer can take legal action and issue a Show Cause Notice (SCN), but this should be done under the supervision of a criminal and labor lawyer.

Legal Implications of Threatening Behavior

Threatening to kill someone is a serious criminal offense and is covered under Section 506 of the Indian Penal Code (IPC). Therefore, it must be addressed legally.

You can advise the exam team leader to file a First Information Report (FIR) at the nearest police station and request them to submit a copy of the FIR to your office. Then you can proceed legally.

Departmental disciplinary action can be taken concurrently and independently of a criminal case, if any. Since you are aware of the factual details of the incident, such as the date, time, place, and specific details, I suggest that you prepare the first draft of the Show Cause Notice (SCN) so that experts in this forum can provide additional input.

Handling Threats in School

On the first hand, you need to have the written complaint from the team of examiners who were threatened. Send the complaint to your higher authority for necessary action. They will initiate action as per service rules and suggest the next course of action. As the Principal of the school, forward a copy of the complaint to the nearest police station to file an FIR.
