Hello Sir/Madam,

Happy New Year to all of you. I want information on whether a person who has obtained a franchise from Sahara is allowed to deduct the EPFO from the commission of their staff (agents). Does the EPFO have the authority for that?

Hi Rajaneesh,

If the staff has a basic fixed salary based on the muster roll of the employee, apart from incentives/commissions (i.e., the ground salary), then they are to be treated as "employees earning wages" and are eligible for wages and other benefits applicable to regular employees.

Commission-based staff covers a wide scope of activities, and it is not clear the role/job profile of the employee to the employer. The employer can be a commission agent or an insurance advisor, which is irrelevant to the benefits.

Thank you.
