Hello All,

I am working in one of the organizations where they sent me to the customer location. At the customer location, I have been working as a consultant for the past 4+ years. Now, my customer is ready to hire me as an on-roll employee.

My questions are below:

Is there any law stating that the customer should not hire a consultant?
If the customer is ready to hire, can the service provider file a case against me or the organization?

I need your support to get answers.

Regards,
Prabhu.

Your organization deploys you to a customer location based on mutually agreed terms and conditions between your organization and the client. There will definitely be a clause stating that the client should not hire you on regular rolls, as it affects the business of your organization. Therefore, your client's office cannot hire you directly. If they do so, your organization has the right to challenge it legally, which can be a time-consuming process. The only option is for you to submit your resignation with your organization, and after proper relieving, you can apply with the client's office, and they can hire you without any hurdles. However, before you submit your resignation with your organization, get confirmation from the client's office. Even though this is not ethical, it will safeguard the interests of your client's office and you as an individual.
