For accidents, the employer needs to submit Form 12 accident report online to ESIC. After discharge from ESI hospital, take all the documents, i.e., Admit form, discharge summary, and rest suggested by the doctor. All these documents have to be shown in the IP (Employee) registered dispensary, and the dispensary doctor will issue a leave certificate in duplicate, of which the original has to be submitted to the ESI branch office and the 2nd copy to be filed by the employer.
At the ESI branch office, the employer needs to submit the wage register, attendance register, witness statement if the accident occurred in the factory premises. The employee will get leave until doctors certify that the employee is fit to join duty.

The above is applicable only if the accident has happened during the course of employment. In the case of accidents not related to employment, the employer cannot upload Form 12. Obviously, if the IP will receive medical benefits, the days will be marked as ESI leave, and that will be unpaid leave. If the accident has taken place during the benefit period (i.e., if the employee has been in service during October 2017 and March 2018 with at least 78 days of working in this period), he will get sickness benefit (cash benefit for these 30 days from ESI Corporation, which is approximately 70% of the daily rate of wages) because the contribution period corresponding to the current benefit period of January 2019 to June 2019 is 1st Oct 2017 to 31st March 2019.
If he was not in employment during the above-mentioned period, he will not get the cash benefit. In the case of employment injury, the above conditions regarding contribution and benefit period will not apply. He will get the average wage for 30 days.
