Employment Details and Resignation

I joined a company on 16.01.2013, and the appointment letter mentioned a 15-day probation period, followed by a one-month notice period or one basic lieu upon confirmation. Meanwhile, our company sold some assets, and some employees were merged into the new company. However, the company did not merge the payroll with the existing employees; instead, they paid our salaries to a third party of their company.

I submitted my resignation on 25.05.2018, and while our reporting was accepted, the HR team did not release me. They are insisting that I serve the notice period. I requested to be released on or before 09.06.2018 as I have an opportunity with another company that has offered me a position to start on or before 15.06.2018.

Potential Legal Concerns

If I join the new company, could I face legal problems from my previous company? Kindly advise.

It is better to quit cleanly by remitting the cash equivalent of the remaining notice period rather than buying the remaining notice period. One can never predict the potential legal issues that may arise when failing to fulfill legal obligations.
