Resignation and Full and Final Settlement

One of my friends worked for an infrastructure company until March 2018. He submitted his resignation without giving any notice period due to personal problems. A few days later, he followed up with his reporting manager (HR Senior Manager) regarding his full and final settlement. He was advised by his reporting manager to complete all the handover formalities before he could receive the full and final settlement.

Following the suggestion, my friend completed his handover formalities and submitted all the documents to his reporting manager (Senior Manager — HR), as he had worked in the HR Department for 8 years. The Senior Manager informed my friend that he would present the case to the Managing Director for approval.

After continued follow-ups, his reporting manager stated that, as per the appointment letter, he was supposed to give three months' notice or pay three months' gross salary in lieu of notice. However, the clause in the appointment letter was applicable for up to three years only. The amount required for the notice period exactly matched his full and final settlement amount.

It is better to go and meet the MD and listen to what he or she says regarding the whole issue. Since there is an issue on your part (your friend, that is) by resigning without any notice, it is always better to be open to what the other person says and see if it can be settled amicably between the two of you. Confrontation should be avoided as much as possible, and after talking to the MD, who knows, your friend may have a solution or at least a satisfactory explanation in place. Don't jump the gun; wait and take an informed decision.

Dear Friend,

You ask your friend to get his F&F calculation sheet. If the receivables are equivalent to the amount payable, there is nothing to do. Your friend must have the information he was expecting to get as remained associated with the HR department. You ask him to claim for gratuity and make an application in the prescribed form as he has rendered 8 years of service.
