Employee Leave Policy Variations and Compliance Concerns - CiteHR

I am from Bangalore and work for a company here that operates in a house rather than a commercial complex. It has come to my attention that employees who joined before April 2017 are eligible for 2 days of leave per month, which totals 24 days excluding holidays.

Those who joined after April 2017 receive only 14 days a year, calculated on a pro-rata basis, which equates to 1 day per month. There is also a rule that post-confirmation after 6 months requires a minimum of 3 days of leave balance to procure 1 day of leave. This means it takes 9 months to earn one day of leave.

The HR policy was not shared with me at the time of joining, and only recently were the changes provided. I would like to know the following:

Leave Eligibility for Confirmed Employees

1. The company is a service-oriented company. How many leaves are eligible for a confirmed employee in general? Specifically, CL, EL, and SL?

Variability in HR Policies

2. Are there HR policies that vary from employee to employee?

PF Employer Contribution

3. Is it correct that the PF employer contribution is also deducted from the employee in this company?

Company must be registered under State Shops and Establishment Act. The Act lays down leave entitlements. Kindly refer to the concerned act.

Leave cannot vary from employee to employee based on the date of joining. Deducting the employer's share of PF is a clear violation of the PF Act.
