We have some single-man posts in shift working with reviler system. Due to 4 persons, 3 days a week, a spare post occurs, i.e., 3 days of double manpower instead of single. Now management is trying to shift the spare person in place of the person who applied for leave. Due to this, mental harassment occurs to staff.

How can we protect ourselves from an industrial dispute? Please guide.

First, analyze the manpower position. If you intend to make changes, discreetly consult with the union. Be well-prepared to explain why the changes are necessary and how manpower can be utilized more effectively. Communicate with the concerned staff in a friendly manner to explain the need for these changes before proceeding.

While reiterating Mr. Nathrao's suggestion to settle the issue amicably, insofar as an industrial dispute is concerned, it is the employer's prerogative to deploy their staff at the point of need unless they violate any provision of the law (working hours, rest intervals, or holidays, etc.), or any settlement prohibits the employer from deploying without the consent of the concerned workman. Therefore, please review your actions for any potential breaches.

It appears you want to raise an industrial dispute on the posting of spare manpower in place of regular manpower in the shift. It is the prerogative of the management to post manpower depending on the contingencies. There is no legally valid reason to object to this arrangement; however, an emotive issue could be raised that by posting the spare manpower in place of regular manpower, a customary privilege is withdrawn, and your earnings by way of OT are adversely affected.
