This is Ramu, working as DM-HR&S in the manufacturing sector. My query is, can we terminate a manager category employee without holding a domestic inquiry by giving one or two months' notice as per his appointment order for reasons such as poor performance, negligence, fraud, misbehavior, etc.?

Kindly provide your valuable suggestions on this query.

If you have "conduct, discipline, and appeal rules" for managerial staff, adhere to the clauses. If you are terminating due to misconduct, it is better to follow the regular procedure of notice/show-cause/enquiry.

If there are still possibilities to settle it amicably, like if the employee resigns and the company pays compensation for 2 months, then you can save a lot of unnecessary effort on both sides.
