Hi Seniors,

Please guide me. I am in a private travel-related company where the number of employees is less than 10. It is an office in Gurgaon. Do we have to give paid leave to our employees or not? If yes, then how much paid leave will be applicable according to the law, and please tell me in which section and act it is mentioned.

You are governed by the state Shops Act. Leave with wages to be given is 1 day for 20 days worked.

Thank you, sir, for your reply. Sir, I want to share one more thing with you - my company is registered under the Companies Act. Does the condition of leave with wages (1 leave for 20 days worked) apply as per the same act?

You need to register under the Delhi Shops & Establishments Act if not already. Even if you are not registered, the act is applicable to you & hence the leave provision.

Please go through the Shops & Establishment Act related to the state where the establishment is. I opine that in addition to the leave with wage, you need to provide the Casual/Sick and even the maternity leave for those female employees who are out of ESI coverage. Please check and comply.
