Hello, My company is going to sponsor (50%-50%) for the higher education of an employee of our company, and please help me create an agreement for this. Thanks in advance.

Dear Priyanka, you are going to sponsor half of the education course fee that the employee will undertake. However, have you asked the employee to submit a proper application that will provide details of the course? What type of course is it, what is the duration, is it full-time or part-time, and what is the fee structure? How will the employee benefit from taking this course, and will there be added value in their day-to-day work? If yes, in what way? Kindly instruct them to attach the course brochure to this application.

Once you receive the application from the employee, you will need to draft the legal agreement. In the preamble, include details of the employee, followed by details of the course. Additionally, include the following:

a) The company will cover part of the course fee. How will it be paid? Will it be paid directly to the institution/university or to the employee's personal account? If the latter, what will be the tax liability?

b) What will happen if the employee discontinues the course midway? Will you request a refund of the portion of the fee paid by the company?

c) Upon completion of the course, do you plan to include a clause requiring the employee to serve a certain number of years in the company?

d) Is the amount that the company will pay refundable or non-refundable? If non-refundable, how many installments will the refund be made in?
