Dear Mr. Nagesh,

First, you have to find out the applicable Minimum Wages to the Principal Employer. Contract Employees working in the Principal Employer Establishment will be governed by the applicable Minimum Wages. Similarly, you have to know whether the Establishment is Governed by the State/Central Government.

Equal pay for equal work

Yes, this query is another example of some individuals trying to seek opportunities for unfair labor practices. Equal pay for equal work is a matter of natural justice. Any type of work approved by the central government that requires higher wages compared to local or state government-approved work usually entails unconditional payment by the contractor.

For instance, tasks such as fixing railway or telecommunications lines, digging works in naval dockyards, HP gas operations, digging wells, etc., which are government projects, are often subcontracted to local village laborers. In such cases, the contractor is obligated to adhere to the wage rates set by the central labor department, even for positions like watchmen, security guards, and other roles involved in central government projects.
