Central Government Minimum Wages and Classification Issues

I am working on a contract basis in an organization where central government minimum wages are applicable. The central government revised minimum wages from 19-01-2017. In this notification, they have clearly stated the wages applicable according to the work. I work as an assistant accountant, which falls under the clerical grade. However, in my organization, they have categorized me as an unskilled worker, impacting my minimum wages.

When I approached my principal employee to inquire about the reason why they classified me as unskilled despite working as an assistant, they mentioned that the classification is based on experience. I want to understand if an organization following the central government minimum wages rule decides skilled or unskilled based on experience or government work category.

Dear Mr. Srivastav,

You have mentioned that you are employed as "Assistant Accountant" and then mentioned working as "Assistant." Please clarify your correct designation. What is your qualification, previous experience, and the nature of the job performed in your present role to determine your category?

Dear Mr. Srivastav,

As you mentioned that you are working as an Assistant Accountant, the minimum wages applicable to the clerical category, based on the nature of your job, will apply and not those of the unskilled category.

Please discuss this matter with your employer once more for the necessary correction. If they do not address it, you should consider approaching the Labour Commissioner's office to file a complaint.
