Dear all members,
I would like to know about the weekly off policy. Suppose an employee worked on a Sunday and would like to apply for leave in the next month. Will it be possible to adjust the leave for the following month?
Formally, I am from an automobile dealership, and we have Sundays off. If an employee works on a Sunday, it will be adjusted within the same month, and it is referred to as "Weekly Off."
Any assistance on this matter would be greatly appreciated. Please reply.
Thank you.

Labour laws do not prescribe a weekly off in that manner. Instead, there is a mandatory leave within a week. If an employee works during that leave, they are entitled to overtime pay and a compensatory holiday. This entitlement is specified under both the Shops and Establishment Act and the Weekly Holiday Act. Therefore, you are entitled to a comp off, which can be adjusted if your employer agrees, potentially offsetting any absences. It is the employer's duty to ensure that you receive your entitled leave.

Generally, when an employee works on a weekly off, it is advisable to give them a day off within 3 days before or within 3 days after the day they have worked. Working continuously will bring down the efficiency of the employees.

Thank you for your valuable reply. I would like to clarify if an employee can take leave on a Sunday if they are scheduled to work. Additionally, if an employee wishes to take leave in the following month, can this request be carried forward or adjusted within the upcoming month?

It should not be as per the desire of the employee; an employee should be avoided to work on the week off. However, if due to any exigency of work, the employer and employee mutually decide to work on the week off, that should be compensated immediately.
An employee from outstation (far away) would prefer to work for the entire month and then take leave for 5-6 days in the following month. This practice should not be entertained.

From your query, I gather that due to the exigency of work, the employee was asked to work on Sunday - the weekly off day. The weekly off should be made available within 10 days. Also, check if there is a mention of compensatory off in the act applicable to your organization and decide accordingly.

There are any rules for Sunday working, and an employee can take a week off as needed. We already run 2 or 3 Sundays in a month and give a week off to employees. The issue now is that 5 Sundays were open, and employees want to take a week off against these Sundays in February 2017.
In this case, what needs to be done? I believe there is no rule for a Sunday week off alternative.

There is no rule for weekly off working. If, due to exigency, an employee needs to be called in to work on weekly off days, it has to be compensated with a compensatory off (General Practice) within 3 days, i.e., an employee can work for 10 days at a stretch to the best of my knowledge.

Your above explanation is unclear.
In a month, there can be 5 weekly offs. Now, if you call an employee to work on a weekly off day, then you have to pay OT wages at double the rate of wages for non-managerial employees and offer comp off to managerial employees. Some organizations follow the practice of giving comp off to all employees, but it is legally incorrect to do so.
