Hi team, I am presently working in a private limited company. I joined this company 9 months ago, and in our offer letter, the probation period is stated as 1 year with a 2-month notice period. However, I am willing to serve a 1-month notice period and pay the difference amount for the remaining month. The offer letter does not specify whether it is based on salary or the full Cost To Company (CTC) for the month. According to our HR's verbal statement, it is one month's CTC. My question is whether it is typically the basic salary that needs to be paid or the full month's CTC. Please advise and assist me.

In the absence of specific mention, it is to be inferred only as one months gross salary only.

If HR has a practice to recover the shortfall of due notice pay from the gross salary, then be prepared to pay the gross salary. It would be beneficial if you spoke to HR and requested for the adjustment of notice pay with the leave balance. You will likely receive support.
