The Employees' State Insurance Corporation (ESIC) raised the monthly wage threshold to Rs. 21,000, from the current Rs. 15,000, for coverage under its health insurance scheme.

Ministry of Labour and Employment has introduced new gazette notification to increase ESI maternity leave to 24 weeks from 12 weeks by introducing Employees’ State Insurance (Central) Amendment Rules, 2016.
According to the new gazette proposal, after its final approval women with following category will also be eligible for ESI maternity benefits:
a commissioning mother who as biological mother wishes to have a child and prefers to get embryo implanted in any other woman;
a woman who legally adopts a child of upto three months of age;
The Objections or suggestions, which may be received from any person in respect of these draft rules within 30 days from the date of publication of this Draft Rules, will be considered by the Central Government.

In my last thread, I had raised the question of the rule of allotment of an Insurance Number within ten days. If the notification is enforced from October 1, 2016, it would be a breach of the law. Currently, the notification has not yet been enforced, so we can't obtain the Insurance number. Should we assign Insurance numbers to those individuals who are expected to become members under the scheme?

In our earlier gazette notifications, the enhancement of the wages limit under the ESIC legislation is prospective, not retrospective. Therefore, any gazette not published before 30.09.2016, can be treated as not implemented. You can continue to recover ESIC Contribution on Rs.15K only for the next six months.

Please check the last notification. It has come into force from May 1, 2016, i.e., in between the contribution period. Sir, as mentioned in the said notification, it is an intention notification and not final. The final notification is expected to be issued by the appropriate government after considering objections/views received from the concerned persons within the stipulated time as mentioned in the above notification. It is difficult to guess and predict within what time and by which date the said final notification will be issued.

The limit should be enhanced from 01 April 2017, not from 01 Oct 2016, because we can't cover the employees under ESIC Scheme from a back date. Some companies have taken the mediclaim policy for the personnel not covered under ESIC who will bear the cost of the premium and also subscribe to ESIC contributions.
Some personnel will be covered under the scheme during Nov 2016 and then removed during Apr 2017 after implementing the annual increment.

We need not cover the employees whose salary/wages are between Rs 15,000 and Rs 21,000 per month as the October 6, 2016 Gazette Notification is only inviting objections from the public within a 30-day period. After the government's consideration of the objections, the final notification will be published in the Official Gazette, mentioning the date of effectiveness for the order.

Hi friends,
Our concern is that many of the staff have crossed the 15000 ceiling as of Sept 16 and are now out of the ESIC limit. Since the October cycle is beginning, we will not be recovering ESIC for them. If the draft is finalized and implemented, they will be back within the 21000 ceiling. Now, the question is, should we continue their recovery for now or stop it and restart it again? Because once we start contributing now, we cannot discontinue the same for this cycle.

No! Notification of applicability was not issued last year and is not expected before December 2016. If the notification is issued in November 2016, it may take effect from December 2016. However, if it is not issued until December 2016, it might have an effect starting from April 2017. (Please refer to my earlier thread dated 10 October for more information).

Further, ESIC has revised eligibility for Super Specialty including the children of Insured Persons with congenital diseases & genetic disorders.
This information was given by Shri Bandaru Dattatreya, the Minister of State (IC) for Labour and Employment, in reply to a question in Lok Sabha today.

In my opinion, the notification has still not been issued, and now it would be possible to be effective from April 2017. This is because the required 92 days may not be completed from January to March 2017, even if someone works for the full month in all three months. New entrants from January 2017 would not be entitled to sickness benefits in the forthcoming benefit period starting from July 1, 2017, following the contribution period from October 2016 to March 2017.

ESIC published new notice on behalf notification issued on 06th Oct 2016 and announced to changes under ESIC act, 1950 section 95 rule 50.
Under the section the words “ fifteen thousand rupees” occurring at both the places, the words “twenty one thousand rupees” shall be submitted.
Now ESIC limit will be 21,000/- effective from January 17 instead of Rs 15,000/-.
