My father was working as a security guard in a private security agency, he had taken proper leave by submitting leave application but during travel he died by train accident.
I want to know that without his PF what can we take from security agency and tell me the rules and regulation of labour act of india as well Madhya Pradesh.

Since your father was not traveled for official purpose (as you mentioned that he was on approved leave), the security agency is not liable to pay any compensation.
Check with the security agency whether they have any private insurance (like group life insurance, accident policy etc.)
He is eligible for Gratuity, even he was with them for less than 5 years.
If he is covered in ESI, you can apply for Rs. 10,000 funeral expenses.
Hope in PF, you are applying for EDLI apart from PF & EPS.

Dear sir,
Kindly describe EDLI? and how can i apply for it.? My father has been died on the age of 54 and retirement age should be about 65 so gratuity amount will be given by 11 times of his half of basic salary..?? As you know that my father was in leave and during travel he died so insurance company is liable to pay insurance money.

EDLI - Employee Deposit Linked Insurance. This is an insurance cover of the employees registered in PF; in case of death of the member during the employment (or in service), the nominee/family members/legal heir can receive the insured amount.
Amount Calculation Formula:
A = Last drawn Basic (Maximum Rs. 15,000) X 30
B = PF Balance / 2 = Maximum Rs. 1,50,000
EDLI Amount = A + B = Maximum Rs. 6,00,000.
This amount will be received by the applicant (nominee/family members/legal heir) in addition to the PF amount and Pension Benefits.
I have attached the EDLI application form and instructions.
Gratuity = Last drawn Basic X 15/26 X No. of years of service. (Maximum 10 Lacs)
If he is covered in insurance (life/accident), you are eligible to claim.

Dear sir,
My father was on contract basis and he was security guard as you know that security guard came into labour category and he had a life insurance. Can we are liable to claim for contract basis employee. My father was working on madhya pradesh. Is there any plan for such type of cases.

Mr. Satyam,
Please clarify whether he worked in contract basis (limited period contract signed between agency & your father) with security agency or he is a regular employee in security agency where he worked as security guard in a company/factory as contract employee (contract between agency & the company/factory).
