It depends on the service regulations or the standing orders of the establishment. Normally, just facing a criminal trial can not be a valid reason for termination of employment.

Pendency of a criminal case won't affect service until judgment in the case. But if not exonerated honorably of the charge, your friend can get terminated or even dismissed.

Regarding the termination policy of TCS, your friend must have received the terms and conditions of his appointment through the offer letter from TCS. He may read the same or refer to the employee manual prepared by the company for detailed guidance.

Impact of Criminal Cases on Employment

In case any employee is involved in a criminal case for actions committed outside the company, it falls under moral turpitude. Following the pronouncement of judgment, if the case is proven and imprisonment is imposed, the company may terminate your employment.

If the criminal act occurs while in service or on duty, they can promptly suspend you by issuing a charge sheet along with a suspension order. The police may also file a case against you, leading to concurrent police proceedings and a company-led domestic inquiry. If found guilty in the inquiry, the company will terminate your employment.

Impact of Criminal Charges on Employment

Any suggestion to this query depends upon the nature of charges framed, the policy of the company in this context, and the final decision of the court.

However, the following basic legal concepts could be relevant: an accused in a criminal case is presumed to be innocent unless proved otherwise. Even an acquittal in a criminal case, especially on the benefit of doubt, does not entail that the accused was not the wrongdoer. The employer can take a different view of the proceedings after affording the employee a chance to show cause. Even if convicted, the continuation in the job may not be affected if the offense, as proved, is minor and did not involve moral turpitude.
