Dear,

We are required to deposit the Labour Welfare Fund Contribution with the Welfare Commissioner of Haryana by the 31st of December each year. This implies that the contribution is to be deposited for the months from December to November. Additionally, as per the amendment notification dated 04.04.2009, this Act now allows for a one-month grace period. Consequently, we can deposit this contribution for both the employer and employees up to the 31st of January (the notification specifies one month from the specified date i.e. 31st Dec., and therefore I am considering this as one calendar month. This period may be 30 days as it is not explicitly clear).

    Dear Mr. Khola,

    We are depositing LWF every quarter to the Labour Welfare Commissioner (Haryana) in Chandigarh. Have the rules been revised to require an annual deposit? Please clarify, as we have been following the instructions of our consultant.

    Dear Saurabh,

    It is hereby made clear that in the beginning, the State Labour Inspectors/L.I. (Welfare) have issued instructions to the LWF Act coverable units to deposit this contribution amount quarterly to implement this new amendment on the verbal or written instructions of the seniors or the Head Office. However, later on, due to the non-availability of any provisions in the Act itself, they are now not providing it in writing. Currently, some of the Inspectors are verbally giving directions to the managements, and due to this, management, like you, are still complying with those instructions.

    As already informed, we are required to deposit this contribution, both from the employee and employer, annually through a cheque or DD. There is no challan system under this Act. The contribution amount of Rs. five is to be deducted monthly from the wages/salary of the employee.

    As per the requirement of Section 9A, we are to pay LWFC, both the employees' and employers' shares, to the Office of Welfare Commissioner, Haryana. We are to provide details to the welfare commissioner, for which I am attaching the draft of the covering letter with details of contributions. This letter was found issued to one of my clients by this office for the submission of LWFC. This Act has not provided us with any return to be sent to any authority.

    An employee is defined as someone whose name is listed on the muster roll on the last day of the month. Could you please clarify whether we should deduct LWF at the time of FNF in the middle of the month?

    For instance, if Ram left on July 7, 2015, should I deduct his LWF at the FNF settlement on July 8?

    Dear R N Khola Sir,

    We are a 7-year-old company in Gurgaon with more than 30 employees. We have not yet submitted the LWF for any year. The last day for LWF return is 31st January. We want to pay the LWF for the last year. Could you please advise me on whether we should wait for Jan-2017 to consolidate with the 2016 LWF or if we can pay now?

    Kindly advise and guide me on the further process.

    You can deposit the amount of labor welfare fund contribution for the year 2016 for both employees and employers at this point in time, along with a 12% interest from January 1st, 2016, until the time of deposit. If you do not make the deposit, then this interest penalty will continue.

    Dear Member,

    One check may be made for both contribution and interest amounts. Details of the check may be provided in the letter. The letter for sending LWFC is attached herewith for your ready reference. The interest rate of 12% on delayed payments is calculated as simple interest.

    Dear Mr. RN Khola,

    Should we deduct the LWF during the time of FNF settlement? For example, one of our employees left the company on June 20, 2016. We are in the process of finalizing his FNF on the same date. Therefore, should we deduct LWF from his June salary or not? Please clarify all.

    I have one query related to ESIC contribution payment for job work within my company premises. Do I need to register the contractor as I would for other IP members (regular employees) and then pay the corresponding contribution, or is there another procedure to fulfill this payment obligation?

  • Hi,

    As I can check, the Haryana Labour Welfare for exit employees who have left in the middle of the month is not accepted online. However, any associate working until the last day of the month, then their LWF amount is calculated. Is there any rule change or notification on this? Because earlier, during manual submission, we deducted the full amount irrespective of working until the end of the month.
