Hi Seniors, I am working as a system engineer and have resigned from my current company. Now my manager is not accepting the resignation. He is saying that he has the right to accept or reject the resignation. Even so, I am ready to serve the notice period. If I refer to the Appointment letter, it says, "Termination Notice: The services may be brought to an end by giving one month's notice to either side or pay salary for the period in lieu of notice period." However, if I refer to their separation policy, there is a clause that states, "Manager has the right to accept or reject resignation."

Conflicting Statements: Appointment Letter vs. Separation Policy

Now, the Appointment letter and separation policy have different statements. Please let me know which one carries more weight. I would like to mention that at the time of joining, we sign and accept the joining letter. I never signed any policy.

Thanks,
Karan

Nowadays, email communication is accepted everywhere. If you really do not want to continue, point out the separation clause in the appointment letter. Clearly mention in the email that your hard copy of the resignation letter was rejected, and hence you are resigning through email communication. Mark a copy of the same to yourself for your records.

An employer cannot refuse to accept a resignation; it is up to the employee to decide whether to continue or resign. The only problem that may arise is that they will take time to issue the service certificate.
