We are medical device manufacturers located in the Navi Mumbai region. In our company, we use various types of weights in the packing section. Are we covered under the Weight and Measurement Act of 2011? If we have to follow compliance under this act, what are the procedures and requirements?

Dear Rupali,

You are covered by the Legal Metrology Act, 2009, and as such, you have to get your weights, measures, and weighing and measuring instruments used in your transactions, whether internal or external, reverified periodically as stipulated in the Rules.

Long back, when I served as an Additional Controller of Legal Metrology in Tamil Nadu, many changes have occurred. Therefore, I am not aware of the exact procedural formalities currently in place in various states. As far as I know, as a user of weights and measures, you need to have all electronic weighing and measuring instruments, as well as higher denomination instruments such as platform scales, reverified and stamped once a year. All other items should be reverified every two years.

If you sell your products in packaged form, you must obtain a license for this purpose. Your packages should only be in the denominations prescribed by the Packaged Commodities Rules in force. They must contain certain statutory declarations such as the name of the commodity, its net contents, maximum sale price, date of expiry for perishable goods, and the name and address of the manufacturer/packer, along with an email ID and customer care contact number.

If you are a manufacturer of weighing and measuring instruments, you need to obtain a license from the Director of Legal Metrology and get your models approved beforehand. It is advisable to consult your area Inspector of Legal Metrology or State Controller of Legal Metrology for the current procedures and any applicable exemptions.
