Dear Seniors
I need your valuable suggestions regarding gratuity as I am not complete 5 years in my current organization.
My date of joining is 28th May 2011 and recently has been submitted my resignation on 14th Jan 2016 with 2 months notice period as my last working day will be on 13th March 2016.
Can I eligible for gratuity as I will be complete 4 years, 9 months and 15 days instead of 5 years.
Appreciate your valuable guaidance.

Dear Omkar,
If an employee has continuous service with single company for 4 year and 240 Days then he/she is eligible to get Gratuity. As you said going to complete 4 years 9 months and 15 days on 13th March 2016, means you are eligible to get gratuity.

Dear Omkar, As per Payment of Gratuity Act 1972, Employee who completed 4 years 240 of continuous service, is eligible to get gratuity.

You will be quite eligible to claim gratuity for service equal to 5 years.

Hi Omkar, you are eligible for gratuity if you have completed 04 years and 240 days. This is not written in act but it has been decided by courts.
